Korte Suprema sinuway ng Kamara

TATALIKURAN ng Kamara ang kautusan ng Korte Suprema na ihinto muna ang impeachment proceedings laban kay Ombudsman Merceditas Gutierrez  na maaaring magpasimula ng constitutional crisis.

Tuloy ang pagdinig ng House Committee on Justice sa September 28 at 29 kung saan nakatakdang pagbotohan kung ang dalawang impeachment complaints ay may ” sufficiency in grounds.”

Sa isang press conference, nanindigan sina Deputy Speaker Erin Tañada at Iloilo Rep. Neil Tupas Jr, chairman ng Committee on Justice na hindi sila magpapapigil sa SC dahil ito ay maituturing umanong panghihimasok sa kapangyarihan ng Kongreso na dinggin ang isang impeachment complaint sa loob ng 60 session days.

Nang tanungin si Tañada kung deklarasyon ng giyera sa Supreme Court ang hindi pagsunod ng Kamara ay sinabi ng kongresista na isang constitutional prerogative ang kanilang aksiyon

“No we are not. We are just responding based on our constitutional prerogative. No, no,  it’s not a declaration of war against the House but it is an encroachment of the power of the House,” paliwanag  ni Tupas.

Ipinaliwanag pa ni Tupas na bilang magkapantay na sangay ng pamahalaan ay mayroon aniyang tinatawag na “separation of powers”.

“We are not defying the order which we believe is not within the spear of jurisdiction of the SC,” ayon pa rin kay Tupas.

Naunang sinabi ni Ilocos Norte Rep. Rodolfo Fariñas, vice chairman ng Justice Committee na  igagalang nila ang TRO na inilabas ng korte.

“We will comply with the TRO and its issuance does not  necessary violate separation of powers as it is the duty of  the SC to look into allegations of abuse of discretion even on  the part of the  legislative,” ni Farinas.

Sa panig naman ni Davao Rep. Karlo Nograles ay pinayuhan niya ang liderato ng Kamara na huwag munang gumalaw hangga’t hindi nalilinawan ang usaping ito.

“That’s the prerogative of the SC.  Perhaps the SC feels that there is a compelling need to   study the arguments of Ombudsman Gutierrez first but  in the meantime the  House Committee on Justice should defer any action on the  impeachment so as not to commit any irreversible damage against the  ombudsman,” sinabi pa ni Nograles.  Meliza Maluntag
