Justices who junked EO No. 1 asked to resign

MAGBITIW na kayo sa puwesto.

Ito ang mariing pahayag ng Akbayan party-list sa sampung justices ng Supreme Court na bumoto para maideklarang unconstitutional ang Truth Commission.

Ang komisyon ay itinayo ng Aquino administration para imbestigahan ang mga eskandalo at anomalyang naganap noong nakaraang administrasyong Arroyo.

“They should pack their things and leave their posts. What they did was not only indefensible and unforgivable; it is also an affront to the entire judiciary system and the people,” ayon kay Ana Theresia Hontiveros, dating representante at ngayo’y tagapagsalita ng Akbayan.

“Their brazenness is unparalleled. Since when did it become unconstitutional to tell the truth and seek justice? They must immediately resign,” dagdag niya.

Aniya, ang desisyong ginawa ng Korte Suprema ang magliligtas kay dating presidente at Pampanga Rep. Gloria Macapagal-Arroyo at ilan pang opisyal ng gobyerno mula sa accountability at prosecution.

Nakapanlulumong isipin na ang dapat sana’y “people’s last court of resort” ay maging “first line of defense” na ngayon ni Arroyo, ayon sa dating kongresista.

“As a result, the high court has totally lost its independence, credence and judiciousness. It has completely exposed itself as a hollow judicial court directed by an old despotic regime which is still very much entrenched in the new dispensation, and whose lust for power is unmatched. Without a shred of a doubt, it is a GMA court out and out,” dagdag pa niya.

Noong nakaraang Hulyo, pinirmahan ni President Benigno Aquino III ang Executive Order No. 1 para likhain Truth Commission.

Anang president, ang komisyon ang magreresolba at magbibigay-linaw at katotohanan sa mga alegasyon ng mga anomalyang ibinabato sa nagdaang administrasyon.

Ngunit ayon kay acting SC public information chief Gleoresty Guerra sinabi ng sampung justices na ang kautusan ni Aquino ay lumalabag sa “equal protection clause” ng Konstitusyon “inasmuch as it singles out for investigation reports of graft and corrupt practices in the previous administration.”

Ang mga bumoto para mapawalang bisa ang Truth Commission ay sina Chief Justice Renato Corona at associate justices Teresita Leonardo-de Castro, Arturo Brion, Presbitero Velasco, Diosdado Peralta, Lucas Bersamin, Mariano del Castillo, Martin Villarama, Jose Perez, and Jose Mendoza.

Ang mga nag-uphold naman ng E.O. No. 1 ay sina associate justices Antonio Carpio, Conchita Carpio-Morales, Eduardo Nachura, Roberto Abad, at Ma. Lourdes Sereno.

Maliban kay Sereno, lahat ng justices ng Korte Suprema ay appointees ni Arroyo.

Magpa-file agad ng motion for reconsideration ang Malacañang sa oras na matanggap nito ang desisyon ng Korte Suprema, ayon kay presidential spokesman Edwin Lacierda.

“Our position is that the EO 1, the Truth Commission, is constitutional and this is a genuine difference of opinion with the Supreme Court,” ani Lacierda nitong Martes.

Ani Lacierda, naniniwala ang Palasyo na magiging malaking sagka ang desisyon ng high tribunal sa mga repormang nais isulong ng gobyerno.
