‘Nakaw na yaman’ ni Reyes puwedeng habulin

KAHIT pumanaw na si dating Armed Forces chief Angelo Reyes ay maaari pang mahabol ang umano’y nakaw na yaman nito, ayon kay Sen. Miriam Defensor Santiago.

Ayon sa senadora, puwede pang habulin ng pamahalaan ang mga tagapagmana ng ari-arian ni Reyes, na nagpakamatay umaga ng Lunes sa harap ng puntod ng kanyang ina sa Loyola Memorial Park sa Marikina City.

Nahaharap si Reyes sa imbestigasyon ng Kongreso hinggil sa umano’y multi-milyon-pisong “payola” at “pabaon system” sa Armed Forces of the Philippines (AFP).

Ang mga pangunahing akusado sa nasabing pagdinig ay sina dating AFP comptrollers Carlos Garcia at retired Jacinto Ligot.

Sa pagkamatay ni Reyes, ayon kay Santiago, ay burado na ang kanyang pananagutang kriminal at sibil at hindi na maaari pang kasuhan sa anumang korte alinsunod sa itinakda ng batas.

“Technically, Gen. Angelo Reyes died with the presumption of innocence on his side, because he never went to trial.  During the Senate investigation, he was a ‘person-in-interest,’ or a ‘suspect,’”  paliwanag ng mambabatas.

Dagdag ni Santiago: “His (Reyes’s) death extinguished both his criminal and civil liabilities.  In other words, his criminal liability was totally extinguished, both as to the personal and the pecuniary penalties.”

Gayunman, ani Santiago, puwede habulin ng pamahalaan ang mga ari-ariang maiiwan ni Reyes sa pamilya alinsunod sa Revised Penal Code.

“However, the Penal Code provides that the obligation to make restoration or reparation for damages devolves upon his heirs.  Thus, his wife and children are obliged to restore whatever property may be proved to have been acquired by illegal means,” aniya.

“In lieu of the deceased, his wife and their children may be summoned to the Senate hearing to investigate whether they have become liable under the anti-graft act,” sabi ni Santiago.  Ernie Reyes
