DILG sinuportahan sa pagkastigo sa anti-RB bill ordinance

NAKAKUHA ng suporta si Interior and Local Government Secretary Jessie Robredo sa pagkastigo sa Barangay Ayala-Alabang na nagbabawal sa pagbili ng kontraseptibo nang walang resete na hakbang laban sa panukalang Reproductive Health Bill (RH bill).

Sinabi ni Sen. Pia Cayetano na kahit binigyan nang mas malawak na awtonomiya ang pamahalaang lokal sa ilalim ng Local Government Code, hindi nangangahulugan na magkaroon ng kapangyarihan ang barangay na magpalabas ng ordinansiya na labag sa Saligang Batas.

“While it is true that Local Government Units (LGUs) were granted greater autonomy under the Local Government Code, this should not be misinterpreted or expanded to include the power to issue ordinances that would contradict the Constitution or any existing national laws,” ayon kay Cayetano.

Tinutukoy ni Cayetano ang ipinalabas na ordinansa ng Barangay Ayala Alabang sa Muntinlupa na nagbabawal sa pagbebenta ng anumang uri ng kontraseptibo nang walang reseta ng doktor.

Bukod sa BarangayAyala Alabang, nagpalabas din nang katulad na ordinansa ang pitong barangay sa Bataan.

“The concerned barangay executives must realize that they cannot arbitrarily arrogate to themselves the authority to determine the safety of any food, drugs and devices in the market, including contraceptives. This power firmly remains with the Food and Drugs Administration (FDA) as mandated by national laws, and so any exercise of this power by the barangay amounts to usurpation of authority,” paliwanag ni Cayetano.

Sinabi pa ni Cayetano na tama ang ipinalabas na kautusan ni Robledo laban sa naturang ordinansa kaya’t nararapat lamang na bawiin kundi man lusawin kaagad ang naturang pangkomunidad na batas sa Muntinlupa at Bataan.

“The Department of Interior and Local Government (DILG) did the right thing when it reminded LGUs not to overstep its bounds on the issue of reproductive health, particularly in restricting the use and sale of contraceptives in their localities,” paliwanag ni Cayetano. Ernie Reyes
