Bicameral Con-Ass sa Cha-Cha, ibinasura

IBINASURA na ni Sen. Miriam Defensor-Santiago ang panukalang magbuo ng bicameral constituent assembly bilang pamamaraan sa pag-aamyenda sa Saligang Batas upang mapaluwag ang dayuhang pamuhunan sa bansa.

Sa interview bago mag-sesyon kanina, sinabi ni Santiago na may mas mataas na antas ng sobereniya ang Saligang batas na hindi basta ordinaryong panukala na dadaan sa proseso ng pagsasabatas sa Kongreso.

“I am chair of the committee on constitutional amendments. I am against passing constitutional amendments by the way it is recommended by the counterpart committee in the House because I believe it is unconstitutional,” ayon kay Santiago.

Sinabi ni Santiago na hindi tama na ipanukala na magkaroon ng pag-aamyenda sa Saligang batas bilang ordinaryong panukala na dadaan sa Kamara saka pagtitibayin ng Senado at magkaroon ng bicameral conference committee hearing.

Aniya, wala siyang ibang posisyon kundi magsagawa ng public hearing kapag inihain ang panukala sa kanyang komite at didinggin ang procedure at hindi gagalawin ang sustansiya ng panukala.

“We are just discussing procedure so far. I am not necessarily against liberalizing the investment climate—that may or may not be good, I will have to study that more deeply. But with respect to the procedure, it is so wrong. It is dead wrong. I’m sure that if it were brought up in the Supreme Court even only as a hypothetical question, it would easily be rejected. But in our system, the Supreme Court cannot issue decisions on hypothetical issues,” giit ni Santiago.

Naniniwala si Santiago na makahihimok ng dayuhang pamuhunan ang bansa kahit hindi amendahan ang Saligang Batas kung mapananatili ng gobyerno ang katatagan at kaayusan sa Pilipinas.
