Kasong electoral sabotage vs Arroyo, wa epek – Angara
ITINURING ni Sen. Edgardo Angara na harassment lamang at walang epekto ang electoral sabotage case na isinampa ng Commission on ElectionS (Comelec) laban kay dating Pangulo at ngayon ay Pampanga Rep. Gloria Macapagal-Arroyo.
Sa panayam matapos ang deliberasyon ng badyet ng Senado ngayong araw, sinabi ni Angara na isang abogado, na hindi makaaapekto ang electoral sabotage case sa temporary restraining order na ipinalabas ng Supreme Court upang payagan na makabiyahe sa abroad si Gng. Arroyo.
“The new case filed against the former president will not affect the TRO issued by the Supreme Court allowing her to travel abroad because this is a new case since when the SC issued the TRO there is no case yet filed against her,” paliwanag ni Angara.
Dahi dito, sinabi ni Angara na maaaring bumiyahe si dating Pangulong Arroyo kahit pa nagsampa ng kasong walang piyansa ang Comelec sa Pasay City Regional Trial Court na tila isang pamamaraan ng administrasyon upang tuluyang mapigilan ang posibleng pagtakas ng pamilya Arroyo.
“When the TRO was issued, there is no case filed yet. The electoral sabotage case was new case which will eventually resolve by the lower. However, the lower court which is under the jurisdiction of the Supreme Court, cannot act on the said case until the Highest Court decides on the issue of the TRO with finality,” ayon kay Angara.
Ayon kay Angara na matagal nang nagpalabas ng desisyon ng Supreme Court na nagsasabing kailangan munang hintayin ng mababang korte ang desisyon ng Mataas na Korte bago makakilos ang hukom ng Regional Trial Court sa kasong isinampa kay Arroyo.
“May ruling na ang Supreme Court on that matter,” aniya.
“Boss ng judge ang SC, so the judge should wait for the decision, no RTC judge will defy the SC because he or she is under the jurisdiction of the Supreme Court and he or she is subject to suspension and eventual imposition of disciplinary action against the judge,” patapos ng senador.
