Mosyon ni Miriam dedesisyunan bukas

MAGDEDESISYON si Senate President Juan Ponce Enrile bilang presiding judge sa impeachment court hinggil sa motion for reconsideration na inihain ni Sen. Miriam Defensor-Santiago hinggil sa inaprubahang subpoena para sa bank records ni Chief Justice Renato Corona.

Ayon kay Enrile, magdedesisyon ang chair, ibasura man o hindi, ang mosyon ni Santiago bago paupuin ang testigo na ipinatawag ng impeachment court upang ilantad ang bank records ni Corona mula sa Philippine Savings Bank (PSB) at Bank of Philippine Islands (BPI).

“The Chair ruled that is hereby order to hear the position of the movant, Senator Miriam Santiago, to express her position in person, and explain to the Court, the motion accordingly,” ayon kay Enrile.

Naunang kinuwestiyon nina Sen. Franklin Drilon at Sen. Panfilo Lacson ang mosyon ni Santiago dahil wala sa Impeachment Rules na maaaring kontrahin ninuman ng miyembro ng Senado ang kautusan ng korte kapag nakapagdesisyon na ang buong miyembro.

“When the Senate president, on the motion by the prosecution, the defense, asked for reconsideration, and Sen. Chiz Escudero said that when a ruling was made by the Senate, the ruling is carried (by the entire member), unless a member ask for a formal vote, and submit opposition,” ayon kay Drilon.

Kinontra din ni Lacson ang mosyon ni Santiago dahil wala naman umano siya sa aktuwal na botohan nang aprubahan ang kahilingan na i-subpoena ang bank records ni Corona, na lubhang pinagdebatehan at pinagkasunduan ng buong miyembrong lumahok sa isang caucus kahapon (Lunes, Pebrerp6).

“Nevertheless the proper thing to do to hear the view of the judge who is absent and give her a chance to express her view,” ayon kay Enrile.
