Kasong Bagansiya, nilusaw na ni PNoy

NILUSAW na ni Pangulong Benigno Aquino III ang kasong bagansiya matapos lagdaan ang Republic Act No. 10158 o An Act Decriminalizing Vagrancy Law noong nakaraang Marso 27, 2012, ayon sa isang liham na ipinadala sa Senado nitong Martes.

Ayon kay Senate President Pro-Tempore Jinggoy Estrada, ipinaalam ng Office of the President kay Senate President Juan Ponce Enrile na tuluyan nang isinabatas ng Pangulo ang naturang panukala na nagpapawalang-bisa sa kasong bagansiya.

Sinabi pa ng batas na mapawawalang-bisa rin ang lahat ng kasong bagansiya na kinahaharap ninuman ngayon kapag epektibo na ang batas, 15 araw matapos mailathala sa Official Gazette ng pamahalaan.

Ayon kay Estrada, ginagawang gatasan ng awtoridad ang kasong bagansiya upang mapagsamantalahan ang mahihirap at walang tahanan.

“There are numerous reports of arbitrary arrests by the police as a result of the wide discretion afforded to law enforcement by the vagrancy law. Police have rounded up the poor, accusing them of vagrancy and holding them on prison cells. Numerous cases of street children arbitrarily arrested by the police have likewise been documented.”

Base sa bagong batas, nilulusaw nito ang Article 202 ng Revised Penal Code na nagkakaklasipika sa bagansiya bilang kasong kriminal.

Base sa Article 2002, tinutukoy sa bagansiya ang: 1) Any person having no apparent means of subsistence, who has the physical ability to work and who neglects to apply himself or herself to some lawful calling; 2) Any person found loitering about public places or wandering about the streets without visible means of support; 3) Any idle or dissolute person who ledges in houses of ill fame, ruffians or pimps and those who habitually associate with prostitutes.

Nakatakda rin sa batas na palalayain ang sinumang kinasuhan ng bagansiya sa kasalukuyan maliban na lamang kung may iba pang kinahaharap na kaso sa korte.
