M’canang: No comment sa psycho test sa mga nominado sa pagka-CJ
NO COMMENT ang Malakanyang sa panawagan ng ilang sektor na isailalim sa psychological test ang lahat ng nominado sa pagiging Chief Justice sa Judicial Bar Council (JBC).
Ang katuwiran ni Presidential spokesman Edwin Lacierda, sa ilalim ng Saligang Batas ay mayroong minimum requirements sa mapipiling magiging kapalit ni dating Supreme Court Chief Justice Renato Corona.
“It’s been provided in the Constitution. As to whether the JBC can provide additional qualifications, that’s something that is we leave with the JBC. As to the constitutionality of those requirements, that’s something I cannot comment. So it’s something… If they wish to impose additional qualifications, that’s something that we leave with the JBC. As to someone… If someone will question the constitutionality of these additional requirements, that’s another matter. So that’s why we cannot comment on those additional qualifications,” ayon kay Sec. Lacierda.
Nauna rito, pumutok ang balitang kapuwa nominado sina Senador Miriam Defensor-Santiago at Franklin Drilon sa nasabing posisyon lalo pa’t kapuwa rin nagpakitang gilas sa nagdaang impeachment trial kay Corona.
“Well, both of them are obviously qualified, both of them are…I think, they belong to the same batch in UP College of Law. They’re both classmates. They’ve both shown their intellectual brilliance in the Senate halls and in the passage of several bills and also during the impeachment trial. Both have shown their brilliance. And therefore as any other candidate for the position of Chief Justice, we believe that both of them are qualified. But Senator Miriam Defensor-Santiago has been nominated to—has been appointed to ICC. So I’m not familiar as to when she will take office or has ICC informed her of the need to assume the position as a justice in ICC. Again, it will be up to both of them. And corollary to the question of—in response to the question of Weng, both of them will have to either decline or accept their nomination by July 2,” ani Sec. Lacierda.
At sa tanong na out of delicadeza ay kailangang mag-decline ang isang nominado na malapit ka Pangulong Aquino gaya na lamang ni Senador Drilon mula sa Liberal Party at isa sa mga aktibong nangampanya kay Pangulong Aquino noong nagdaang eleksyon.
“We believe that all of them are qualified. And you will have to reject or accept it based on your own belief that you can contribute to judicial reform. But ultimately, it will be up to the Judicial and Bar Council to evaluate a person whether he belongs to a political party, whether he is a senator, whether he is a celebrity or celebrity lawyer. It depends. The résumé will help in the evaluation, but certainly, the interviews with the JBC members will add and would amplify whether a particular nominee qualifies to become the next Chief Justice,” ani Lacierda.
Malabo namang itigil ng JBC ang pagtanggap ng mga nominado sa susunod na Cj ng Korte Suprema dahil na rin sa patuloy na pagdagsa ng mga nominado dahil na rin sa Hulyo 2 pa ang deadline nito.
“No, it cannot because they already issued a decision to extend the nomination until July 2. And you shouldn’t be bothered as to the fact that there are—how many? More than 50 applicants to the position of Chief Justice primarily one should not be concerned because we will know by July 2 of all those more than 50 nominees, how many of them will be signifying their assent to be nominated. [-unclear-], there are only about less than 20 or around 15 or less who have signified their intention to run or rather to vie for the position of Chief Justice. So by July 2, my understanding is, silence means you’re not interested anymore. So if JBC does not hear from you, you’re immediately taken out after July 2. So ‘yon ‘yon. So by July 2 malalaman natin kung iilan ang matitira. As to whether it’s an asset to be a member of the political party, that is not something that we are going to have a say on because the JBC, the Judicial and Bar Council will be the ultimate decision-maker as to the final list of three people to be submitted to the President. So sila ang magdedesisyon, sila ang mag-i-interview doon sa mga kandidato,” ang paliwanag ng opisyal.
At kahit, aniya, sangkaterba pa ang pangalan na nasa listahan ng JBC ay doon pa rin pipili ang Punong Ehekutibo ng ipapalit kay Corona.
