De Lima gigil mapasama sa shortlist ng JBC

TILA KINUNSINTI ng Malakanyang ang ginawang pagpapadala ng pitong pahinang liham  ni Justice Secretary Leila de Lima  sa Judicial and Bar Council (JBC) para ipagpilitang isama siya sa shortlist ng mga pangalan na pagpipilian ni Pangulong Benigno Aquino III na susunod na Chief Justice ng Korte Suprema.

Sinabi ni Presidential spokesman Edwin Lacierda na karapatan ni Sec. de Lima na sulatan ang JBC lalo pa’t umugong ang balitang disqualify siya na mapasama sa shortlist dahil mayroon siyang nakabinbin na disbarment case.

“She believes strongly that the disbarment case was politically motivated and hence it is her right to state so and ask the JBC to consider that in the light of the letter that should be considered as one of the—that she not be disqualified immediately from selection,” ani Lacierda.

“It is a request from Leila de Lima. Well, everyone can… Because obviously there is a case—disbarment case filed against Secretary Leila de Lima and she is just laying out the basis why this disbarment case should not be considered by the JBC considering that they were filed in the light of her opposition to the removed Chief Justice (Renato) Corona,” sabi ni Lacierda.

Ipinauubaya na ng Malakanyang sa JBC ang pagtugon sa hirit ni de Lima na isama ang kanyang pangalan sa shortlist na pagpipilian ni Pangulong Benigno Aquino III na susunod na Chief Justice.

Sa ulat, nagpadala ng pitong pahinang liham si Sec. de Lima sa  JBC kung saan hiniling ng Kalihim na makasama sana ang kanyang pangalan sa shortlist na ipapadala kay Pangulong Aquino.

“We will leave it with the JBC to determine in its discretion the validity and weight of the letter of Justice Secretary Leila de Lima,” ang pahayag ni Presidential spokesman Edwin Lacierda.

Pipili pa rin si Pangulong Aquino sa shortlist na ipapadala sa kanya ng JBC sa kabila ng babala ng ilang lider ng dalawang Kapulungan ng Kongreso na kumukuwestiyon sa constitutionality ng komposisyon ng konseho.

“As far as the Constitution requires, you have to pick from the shortlist. But I don’t know kung the SC will be able to render a resolution on the… Did they file a motion for reconsideration already? I’m not sure but my understanding is the congressional leaders will file a motion for reconsideration on the judgment by the Supreme Court. There is an en banc tomorrow but I don’t know if they are going to file it in time,” ang pahayag ng opisyal.

Kumbinsido si Sec. Lacierda na wala namang magiging problema kung ituloy man ng Pangulong Aquino ang pagpili sa magiging kapalit ni dating SC Chief Justice Renato Corona kahit may ganitong problemang kinahaharap ngayon ang JBC.

“As far as we know, because Constitution requires him to choose from a shortlist. So… But if it will be questioned later on, it’s up to everyone to… It’s a right of a citizen but we are only complying with the constitutional requirement,” ani Sec. Lacierda.

Samantala, pinalagan ng Malakanyang ang ulat na pilit nilang itinutulak si de Lima na maging susunod na Chief Justice ng SC.

“I wasn’t able to… I couldn’t say that. We’re very happy with her being our Secretary of Justice. We’re very comfortable with her. We… Either way, we would certainly welcome her—she be the Chief Justice, she be the DOJ (Secretary). Well, it’s… But, again, that’s up to the JBC,” ani Lacierda
