Malakanyang naghahanap ng kinatawan kapalit ni De Lima sa JBC
NAGPASAKLOLO na ang Malakanyang sa Judicial and Bar Council (JBC) na hanapan ng kapalit si Justice Secretary Leila de Lima bilang kinatawan ng Executive branch na hihimay at sasala sa magiging kapalit ni dating Supreme Court chief Justice Renato Corona.
Sa katunayan sinulatan ni Executive Secretary Paquito Ochoa Jr ang JBC noong Hulyo 13 na tulungan silang humanap ng magiging kapalit ni de Lima sa JBC bilang miyembro nito.
Ayon kay Presidential spokesman Edwin Lacierda, si de Lima ay isang ex-officio member ng JBC subalit dahil nominado ito sa posiyon na iniwan ni Corona ay naiwang bakante naman ang posisyon nito sa JBC.
“As you know the secretary of justice is the only position occupied by the executive branch the others are while they are appointed by the president they do not represent the executive branch. Furthermore the secretary of justice is the alter ego of the executive branch so if we have secretary de Lima being a nominee the voting by the executive branch through the secretary of justice will be left vacant and hence they are acting for a representative as an ex-officio a representative of the executive branch to represent to replace secretary of justice as an ex officio member of the JBC,” ang paliwanag ni Sec. Lacierda.
Wala namang nabanggit na pangalan si Ochoa sa kanyang liham sa JBC na puwedeng pumalit kay de Lima sa JBC.
Kaugnay nito, wala namang naibigay na deadline sa JBC hinggil sa usaping ito dahil sa pagkaka-alam ni Sec. Lacierda ay pag-aaralan munang mabuti ng JBC ang request na ito ng executive branch.
“I think the JBC would be deliberating on the letter,” aniya pa rin.
At sa kung saang ahensiya naman puwedeng humugot ang JBC na puwedeng ipalit kay de Lima bilang miyembro nila ay sinabi ni Sec. Lacierda na ” While it may be true that the president appoints the other members of the council, the representatives of the academe, the integrated bar, the retire justices and the private sector these appointees are not alter ego of the president and do not represent the executive branch. The executive branch assured of representation only through the secretary of justice. That’s why in this instance, the secretary of justice is herself one of the nominees and therefore has to inhibit herself. The executive branch will not have a representative in the council during the deliberations for the selection of the nominees for the chief justice,” ani Lacierda.
“In the event that the SC assigns and the council accept the designation of an associate justice as ex-officio chairman of the council and they have designated associate justice Peralta as the ex officio chairman, the executive branch is also asking for representative for the executive branch. In the event they accept the designation of a associate justice we are also asking for the same courtesy,” sabi ni Lacierda.
Dahil hindi nagbitiw sa puwesto si de Lima, hindi naman puwedeng magtalaga ang Malakanyang ng OIC bilang Secretary of Justice.
