Pagpili ng susunod na CJ, hindi popularity contest

HINDI popularity contest o Filipino idol ang pagpili ng Judicial and Bar Council (JBC) para sa susunod na Supreme Court Chief Justice.

Ayon kay Presidential spokesman Edwin Lacierda, hindi porke’t live broadcast ang  pag-interview sa mga nominado ay mayroong magiging popular habang may ilan naman ang kaiinisan ng publiko.

“It’s possible but the decision-maker is just one person—the President. So it’s possible (that) after the interview some lawyer may become more famous than the others. Some people would prefer this particular interviewee to be the Chief Justice. But, then again, the final decision is with the President,” ani Lacierda.

Sa kabilang dako, hindi na nagawa pa ng Pangulong Aquino na panoorin pa ang pag-interview sa mga nominado na papalit kay dating Supreme Court Chief Justice Renato Corona.

“I am certain that it will not influence his decisions in the event that the three names are submitted. He may choose any means by which to verify the three and that’s normally what he does—that he gets to the talk to the three also and to see.”

Sinabi pa  ni Lacierda na malaki ang magagawa ng interview sa mga nominado sa gagawing pagpili ng Pangulong Aquino na kapalit ni Corona dahil “The President is limited to three (nominees). So he will just have to wait to the three names that will be shortlisted by the Judicial and Bar Council.”

Bukod dito, ibabatay rin ng Pangulong Aquino ang kanyang desisyon sa constitutional requirements alinsunod sa charter.

Sugat ng korte

TIKOM naman ang bibig ng Malakanyang sa naging pahayag ni Supreme Court Justice Roberto Abad na ang pagkakasibak kay Corona mula sa puwesto ay nag-iwan ng sugat sa korte kung saan ang makakagamot lamang sa sugat na ito ay taga-Korte Suprema rin.

“That’s a sales pitch from an insider. I can’t comment other than that. Obviously, he feels that he is qualified to do it and that’s understandable for him to say that he’s qua[lified to be the Chief Justice’, so we respect his right to say that,” ani Lacierda.

At kung taga-labas naman ang mapipiling kapalit ni Corona ay sinabi ni Sec. Lacierda na  posibleng magamot din ng taga-labas ang sugat na nalikha sa pagkakasibak kay Corona.

“Yes. I certainly believe that an outsider—whether an outsider or insider—can heal a wounded court? I think from the point of view of the executive branch, I think we reformed… It is an important step in judicial reform. So we don’t necessarily follow that it is a wounded court. In fact, it’s part of our advocacy for reform,” ayon sa opisyal.

De Lima madidismaya

GINAGALANG ng Malakanyang ang naging pahayag ni Justice Sec. Leila de Lima na madidismaya ito kapag hindi napasama sa shortlist na isusumite ng Judicial and Bar Council (JBC) sa Pangulong Benigno Aquino III.
“Well, obviously, we respect her… Well, we respect her views in the same manner that we respect the view of Justice Roberto Abad. But, again, the decision of the President would be based on how a candidate fills the requirements under the Constitution,” ayon kay Sec. Lacierda.

Magugunitang, marami ang nagsabing kayabangan o pagiging arogante ang pahayag ni De Lima at dapat umanong maging mapagpakumbaba.

Aniya, hindi nila madidiktahan ang JBC kung paano isagawa ang public interview sa mga nominado.

Ito’y matapos mapuna na nakasentro lamang sa talino, kakayahan o background ng mga nominees ang pinipiga at hindi sinasala ang kanilang “moral fitness” na maupo sa Korte Suprema.

Pero kung sila ang tatanungin, hangad din nila ang “morally upright” na chief justice kapalit ni Atty. Renato Corona na pinatalsik sa puwesto sa pamamagitan ng impeachment.
