Angara kay PNoy: Sampal sa JBC ‘pag ibinalik ang shortlist
IBINABALA ni Senador Edgardo Angara na sampal sa Judicial and Bar Council (JBC) kung ibabalik ang shortlist na naglalaman ng walong nominado kapalit ni dating chief justice Renato Corona na pinatalsik noong Mayo.
Sa panayam matapos ang pulong ng National Executive Council ng Laban ng Demokratikong Pilipino sa Manila Hotel, lubhang mahuhusay ang personalidad na nasa listahan na isinumite kay Pangulong Aquino kaya walang kadahilanan upang ibalik ang short list.
“Theoritically, it can be returned back to JBC, but it is a slap to JBC, as the constitutional mechanism for screening candidates in the Judiciary. It is a constitutional requirement, but sakaling ibabalik niya, hindi magandang precedent yan, unless there is a compelling reasons. But I don’t see anything,” ayon kay Angara.
Sinabi pa ni Angara na hindi mediocre list ang isinumite kay Aquno, bagkus outstanding list dahil kumakatawan ito sa cream of the crop at jewels of the profession sa sangay ng Hudikatura,
“It is not a mediocre list, in fact it is an outstanding list, to me, of those available who was pre-qualified, the 22 more or less represents the cream of the crop and jewels of the judicial sectors. Kung ibabalik, more or less the same list will also be submitted to you, it could be in a short list or mid list, medyo iba. But from the cohorts you will chose will also be the same,” aniya.
“I don’t see any compelling reason why it should be return back to JBC,” dagdag ng senador.
Ipinaliwanag pa ni Angara na dapat magpasalamat si Pangulong Aquino sa pamamaraan ngayon sa pagpili ng susunod na punong mahistrado dahil bago mapagtibay ang 1987 Constitution, tanging nasa Pangulo lamang ang karapatan na pumili nito.
“In the past, before 1987, the nominees to chief justice are chosen only by the President, then it goes to the Commission on Appointments. There is no JBC then, but there is a CA, which as you, know now, that examine the best of qualification every candidate,” giit ni Angara.
“Mabuti na nga ngayon, the president has a wider way to choose from. Kung siya lamang ang namimili, siympere, sino ang pakikinggan nya, secretary mo lang, legal adviser mo or your political leaders mo, but this one, it became professional representative of a small body that will recommends, more rational in selection process,” dagdag pa niya.
“Kung talagang mahihina ang qualification the 8 nominees, that is compelling reasons to return the list to JBC, but there is none. The nominees meet the very high standard in their jobs,” patapos ng LDP chief.
