Sulat ng imbentor at kabulukan sa BIR
Isinasalaysay ng imbentor na si Edgar Lozada Delibo sa kanyang sulat ang panggigipit umano sa kanya ng Bureau of Internal Revenue-Regional Office XI sa pamamagitan ng paniningil sa kanya ng milyon-milyong buwis umano mula sa kanyang kinikita bilang isang imbentor at negosyante.
Hindi matanggap ni Delibo ang pagtrato sa kanya ng BIR lalo’t hindi umano pinaiiral ng BIR ang nilalaman ng batas na Republic Act No. 7459 o Inventors and Invention Incentives Act of the Philippines na umiiral na mula pa noong taong 1992.
At ang masama, ginusto ng isang mataas na opisyal ng BIR sa nasabing lugar na kikilan siya ng P50 mil para maayos na umano ang lahat.
Ang P20 mil dito ay para umano sa pamahalaan samantalang “for the boys” umano ang P30 mil.
Dahil sa paglapastangan umano ng taga-BIR sa batas at pagnanais na rin umano ni Delibo na makatulong sa paglilinis ng pamahalaan mula sa kamay ng mga corrupt, pina-entrap nito ang taga-BIR na si Atty. Roderick Orallo, ng BIR Regional Office XI, sa kasong robbery extortion.
Idinetalye ni Delibo ang buong pangyayari sa kanyang sulat sa Ingles na hindi na natin binawasan at dinagdagan upang malaman ng mga kinauukulan ang buong mensahe nito.
Narito ang sulat, mga Bro.
My Fellow Inventors, Filipinos and my Country:
I am asking for your kind assistance in my recent plight to fight against bribery, red tape, extortion and corruptions in the government which caused some disarray in a lot of government transactions and distrust to the business communities of this country especially the Filipino inventors and investors.
For your information, just last September 27, 2012, at about 11:30 in the morning with the assistance of the CIDG, we entrapped through a legitimate entrapment operations at Apo View Hotel, Davao City one Atty. Roderick Orallo of BIR Regional Office – Legal Department who demanded compromise money to amicably settle the case they filed against me before the City Prosecutors Office in Davao for allegedly violation of Tax code.
I never expected that such a government procedure may be railroaded by mere payment of compromise money of P50,000.00.
I never desired that same incident would occur, but, as my obligations to be part of making a corrupt free and morally high government, I asked the assistance of our police not to pinpoint the individual involved here but to make statements that there is an evil culture of corruption within the bureaucracy.
This actually is an effect of government’s non-implementation the Republic Act No. 7459 or the Inventors and Inventions Incentives Act particularly by the BIR which has been mandated as the collecting arm of government.
I am a legitimate Inventor of Herbal Medicines and duly recognized by various government and private award giving bodies.
The intent of the said law, which is to recognize and grant incentives to inventors particularly extending tax exemptions for every invention, was not implemented.
I was not unfortunately given the privilege for said tax exemptions by the BIR based on the said law despite effort on my part.
Except the City Government of Davao which granted me without questions the full privilege for tax exemptions due to their honest implementation of the law and their recognition of Inventors contributions to society.
BIR only granted me income tax exemptions, which, to my analysis runs counter to the intent and purpose of the law.
In fact, the BIR billed me with millions tax payable before the conduct of actual investigations on their level.
The said entrapment operation was the sad effect of the failure of BIR to fully implement the said law in as far as tax policies are concerned which I was persistently asking them ever since.
BIR is supposedly the arm not only to impose taxation and collect taxes but as the office of the government where people can ask assistance regarding tax policies and body which can help implement fairness and justice in taxation.
Some personnel of BIR Regional Office XI asked compromise money of P20,000.00 to settle the case they filed against me plus the “for the boys” money of P30,000.00.
It was so malicious because the government will only earn 20,000.00 while the people trusted to implement the law would gain P30,000.00.
Said scenario really lost my trust and confidence as inventor, businessman and taxpayer.
I was made a victim of Robbery Extortion by the BIR despite the fact that I am supposedly clothed with inventions act privilege which was not granted in the guise of blurred implementing policy of the law, how much more the small, neophyte inventors, investors and taxpayers.
I really felt great loss of confidence to the government processes particularly with BIR and hopefully, not to the entire Government of the Republic of the Philippines.
I am asking for your oneness in these hard times of my life as I am afraid that BIR will counter attack me and my business in sympathy to their colleagues.
