Pag-block ng NTC sa news websites alinsunod sa hiling ni Esperon pinalagan ng IBP

MANILA, Philippines- Iginiit ng Integrated Bar of the Philippines (IBP) nitong Sabado na walang awtoridad ang National Telecommunications Commission (NTC) na i-block ang ilang news websites base sa hiling ng National Security Adviser.
Sinabi ng IBP na ang NTC “cannot restrict access” sa mga miyembro ng media batay sa alegasyon ni National Security Adviser Hermogenes Esperon, at inilarawan ang aksyon na “drastic” at isang “shortcut” upang patahimikin ang press.
“To take down the websites is to muzzle their owners. Such a drastic move can’t be anchored on statements that in court would be treated as hearsay,” pahayag ng IBP.Â
“Neither may it extend the scope of the Anti-Terrorism Council’s designation order to ‘affiliates’ at the barest invocation of terrorism,” dagdag nito.
Matatandaang hiniling ni Esperon sa NTC na i-block ang websites na may kaugnayan umano sa Communist Party of the Philippines-New People’s Army-National Democratic Front (CPP-NPA-NDF), kung saan kabilang ang websites ng mga progresibong grupo at independent media.Â
Saklaw ng NTC order, na may petsang Hunyo 8, ang halos 30 websites, kabilang na ang kay CPP’s founding chairman Jose Maria Sison at ang Philippine Revolution Web Central.
Kasama rin ang mga sumusunod na websites sa listahan: Save Our Schools Network, Bagong Alyansang Makabayan (BAYAN), Pamalakaya Pilpinas, Bulatlat at Pinoy Weekly.
Pinuno naman ng news outfits ang NTC at si Esperon, at sinabing wala man lamang due process bago i-block ang mga website.
“The [National Security Council’s] letter-request, bereft of legal basis, only serves to embarrass the outgoing administration,” ayon sa IBP.
“The Supreme Court has already affirmed the constitutionality of [Anti-Terrorism Act’s] designation process. The NSC is encouraged to use the fruits of this victory and file the proper cases and requests for designation instead of resorting to censorial shortcuts,” dagdag ng grupo. RNT/SA

MANILA, Philippines- Inanunsyo ng Philippine military nitong Sabado na sa kabila ng shadowing at radio challenges mula sa Chinese Coast Guard vessel, ang Western Command (WESCOM) “successfully rotated troops and reprovisioned the beached BRP Sierra Madre (LS 57) in the Ayungin Shoal.”
Nadala rin ang mga suplay sa Ayungin detachment sakay ng indigenous boats na Unaizah Mae 2 at 3 mula Hunyo 20-22, 2022.
Nakarating na rin ang bagong batch ng mga tauhan sakay ng Sierra Madre, upang siguruhin ang presensya ng Pilipinas sa Kalayaan Island Group.

MANILA, Philippines- Dismayado ang Malakanyang sa pinakabagong hiling ng International Criminal Court (ICC) Prosecutor Karim Khan na ipagpatuloy ang imbestigasyon kaugnay sa “rights situation” sa Pilipinas, pitong buwan matapos na suspendihin ito dahil sa apela ng gobyerno.
“For the nth time, we express exasperation on the latest request of the International Criminal Court (ICC) Prosecutor Karim Khan,” ayon kay acting presidential spokesperson Martin Andanar sa isang kalats.
Sa ulat, hiniling ng taga-usig ng ICC sa pre-trial chamber na payagan ang pagpapatuloy ng imbestigasyon ukol sa “war on drugs” sa Pilipinas sa ilalim ni Pangulong Rodrigo Roa Duterte.
Nakasaad sa 53-pahinang resolusyon, sinabi ni ICC prosecutor Karim Khan na hindi naipakita ng Philippine government na nag-imbestiga ito o iniimbestigahan nito ang mga mga mamamayan o iba pa na sangkot sa serye ng patayan na may kaugnayan sa anti-drug campaign.
Muling inulit naman ni Andanar na “amid our hugely successful anti-illegal drug campaign that saw a massive dip in crime incidents attributed to drug abuse, the Duterte administration has undertaken, through the Department of Justice, in partnership with the Philippine National Police, among others, investigations of all deaths that have arisen from lawful drug enforcement operations.”
“This shows transparency and the efforts to address alleged flaws in the campaign are in fact supported by the United Nations in its 3-year technical cooperation program with the Philippines known as the Joint Program on Human Rights that took effect in July last year,” dagdag na pahayag nito.
Matatandaang, pansamantalang itinigil ng ICCÂ ang imbestigasyon sa anti-drug war campaign ni Pangulong Duterte.
Pinagbigyan ng ICC ang kahilingan ng gobyerno ng Pilipinas na huwag munang ituloy ang pagdinig sa kasong crimes against humanity laban kay Duterte.
Ayon sa dokumento ng ICC na may petsang Nobyembre 18, pansamantalang sinuspinde ng prosecution ang imbestigasyon habang isinasagawa ang assessment sa scope at epekto ng “deferral request.”
“Notably, the Philippine government makes no reference at all to any investigation into crimes committed before July 2016, nor to any investigation into crimes other than murder—and, even then, only murders allegedly carried out in police operations, as opposed to murders allegedly carried out in other relevant circumstances,” ang pahayag ni Khan sa kanyang request sa chamber.
“The Philippine government does not appear to be investigating whether any of the alleged crimes were committed pursuant to a policy or occurred systemically, or whether any person in the higher echelons of the police or government may be criminally responsible,” dagdag na pahayag nito.
“For these reasons alone, the Court should not defer to the Philippine government’s investigation,” aniya pa rin.
Sinabi pa ni Khan na ang impormasyon at komunikasyon na isinumite sa prosekusyon ng civil society organizations ay nagpapahiwatig na kailangan ang ICC investigation.
Tinukoy nito ang report ng Commission on Human Rights (CHR) hinggil sa imbestigasyon na sa drug-related killings mula 2016 hanggang 2021, kung saan natuklasan na ang gobyerno ay “failed in its obligation to respect and protect the human rights of every citizen, in particular, victims of drug-related killings.”
Binanggit din ng CHR ang “culture of impunity” na nagsisilbing pananggalang ng mga perpetrators para papanagutin.
“Similar views and concerns have been communicated to the Prosecution by non-governmental organizations and groups representing victims, all supporting the resumption of the Court’s investigation,” ayon kay Khan.
“Without such an investigation, the prosecution submits that there is a real risk that Rome Statute crimes committed in the Philippines will go un-investigated and unpunished,” dagdag na pahayag nito.
Samantala, ang hiling naman ni Khan sa chamber ay “issue an order, on an expedited basis, setting out the procedure in deciding his request; receive more observations it considered appropriate from victims and the Philippine government, according to an expedited schedule; and authorize the resymption of the court’s investigation in the situation in the Philippines, notwithstanding the deferral request.” Kris Jose
