MANILA, Philippines- Nag-isyu ang Department of Justice ng nirebisang mga alituntunin ukol sa mga apela mula sa rulings ng prosecutors saNational Prosecution Service “in the interest of speedy, efficient, and effective administration of justice.”

Ayon sa department circular no. 27 na may petsang Hulyo 13, ang regional state prosecutors at ang Prosecutor General ang may hawak ng desisyon sa apela sa mga kasong “cognizable” ng metropolitan at municipal trial courts.

“Cases decided on appeal by the Prosecutor General and by the Regional State Prosecutors under this provision shall be considered final and no longer be appealable to the Office of the Secretary of Justice,” saad sa circular.

Subalit, nakalahad din sa circular na may karapatan pa rin ang Secretary of Justicena surrin ang mga apela “in the interest of justice, to afford fair play, and prevent the miscarriage of justice.”

“This residual power of review shall conform with the constitutional requirements of due process and will be covered by a relevant department circular to be issued by the Office of the Secretary of Justice,” dagdag pa dito.

Nakasaad na sa department circular no. 70-A na ipinalabas noong Hulyo 10, 2000 na kinakailangang resolbahin ng regional state prosecutors ang apela nang may pinalidad.Binigyang-diin sa pinakabagong circular na hindi na maaaring iakyat sa Justice chief ang mga apela.

Gayundin, inilahad ng DOJ na bubuo ng Prosecution Integrity Board upang bantayan ang pagsasagawa ng preliminary investigations at appeals ng Prosecutor General at regional/provincial prosecutors. RNT/SA
