Batas na puprotekta sa freelance workers papaspasan ng Kamara

MANILA, Philippines – Hiniling ni Davao City 1st Rep Paolo Duterte na ipasa agad ng House of Representatives ang batas na magbibigay proteksyon sa mga freelance workers  kasunod na rin ng naging desisyon ng National Labor Relations Commission (NLRC) na kumatig sa delivery riders na una nang sinibak sa kanilang trabaho.

Ayon kay Duterte, bagamat pumabor ang desisyon ng NLRC sa mga delivery riders ay mas mapapabilis sana ang pagresolba sa kaso kung mayroong batas na nagpoprotekta rito laban sa exploitation at pang-aabuso.

“We won’t be commenting on the details of the case as this is still a continuing legal battle between the two parties. What we would like to point out, though, is that this issue has highlighted the lack of protection and benefits for freelancers. This could be corrected by passing a pending measure in Congress that squarely addresses this longstanding concern in our fast-growing gig economy,” paliwanag ni Duterte.

Ang tinutukoy ni Duterte ay ang pagsasampa ng kaso ng pitong delivery riders sa Davao City laban sa operator ng isang app-based food delivery platform.

Ang mga rider na kinakatawan ng Davao United Delivery Riders Association Inc. (DUDRAI) ay iligal na tinanggal sa trabaho at pinagbawalan na gumamit ng kanilang mobile app sa loob ng 10 years bilang parusa.

Sa desisyon ng NLRC, sinabi nito na mayroong employer-employee relationship sa pagitan ng mga rider at kumpanya na kanilang pinapapasukan kaya naman hindi sila maaaring basta na lamang tanggalin sa trabaho.

“The termination of the riders and barring them from using the company’s mobile app for 10 years is tantamount to “constructive dismissal” nakasaad sa desisyon ng NLRC.

Sinabi ni Duterte na maraming nakabinbin na panukala sa Senado at Kamara para sa mga freelance workers subalit hindi nabibigyang prayoridad.

Isa dito ang House Bill No. 3738 na inihain ni  Duterte kasama nina Benguet Rep. Eric Yap and ACT-CIS Partylist Reps. Edvic Yap at Jeffrey Soriano.

“HB 3738 aims to recognize and protect the rights of freelancers like couriers and delivery riders, along with millions of other workers identified under the measure as independent contractors. In the absence of a law providing them protection from abuse, many freelancers are hired with vague and unclear conditions, leaving them to fend off for themselves in instances when payments for their services are delayed, unreasonably reduced, or worse, not given to them at all,” paliwanag ni Duterte.

Umaasa ang mambabatas na tutukan ng Kongreso ang pagpasa ng nasabing panukala bilang proteksyon ng mga freelance workers sa unfair labor practices.

“HB 3738 would mandate written contracts in obtaining the services of freelancers, along with night differential and hazard pay that shall be provided whenever applicable. The bill also makes it unlawful to commit any form of retaliation arising from the acts of freelancers meant to protect their rights as workers” pagtatapos pa ni Duterte. RNT
