China pwedeng kunin na service contractor sa oil, gas exploration – Carpio

MANILA, Philippines – Nagbigay ng legal parameters para sa joint exploration kasama ang isang dayuhang kompanya ang naging ruling ng Supreme Court kaugnay ng Joint Marine Seismic Undertaking (JMSU) na pinasukan ng bansa kasama ang China at Vietnam noong 2005.

Ito ang sinabi ni retired Supreme Court Associate Justice Antonio Carpio nitong Martes, Enero 10.

“This means the four modes in Section 3, Article XII of the Constitution must be followed,” aniya, na tumutukoy sa “direct undertaking, co-production, joint venture and production sharing.”

Sinabi ni Carpio na maaaring ituloy ni Pangulong Ferdinand “Bongbong” Marcos Jr. ang “direct undertaking” at kunin ang serbisyo ng isang Chinese company para sa oil at gas exploration.

“The service contractor is the agent and the PH government is the principal. The PH will have full control of the operations under the service contract,” aniya.

“The first whereas clause of every PH service contract states that the oil and gas belong to the Philippines. Another provision states that PH law shall govern the contract,” dagdag pa nito.

Sinabi pa ni Carpio na ang pagsasagawa ng direct undertaking route sa exploration at ang pagkakaroon ng service contract ang tanging paraan upang makibahagi ang isang majority-owned foreign company bilang service contractor.

Ang tatlo iba pang pamamaraan na binigyang mandato ng Konstitusyon ay maaaring gawin kasama ang 60-40 na Filipino company.

“This will prevent any administration from straying away from Section 2, Article XII,” aniya.

Nitong Martes, idineklarang unconstitutional ng SC sa botong 12-2-1 ang JMSU dahil pinapayagan nito ang wholly-owned foreign corporations na gumalugad sa yaman ng bansa.

Ang JMSU ay nag-expire noong Hunyo 30, 2008 na kasunduan ng Philippine National Oil Company, China National Offshore Oil Corp., at Vietnam Oil Gas Corp. patungkol sa paggalugad ng langis sa 142,886 square kilometer ng South China Sea.

Nag-ugat naman ang kaso sa petisyon na inihain ni dating Bayan Muna Party-List representatives Satur Ocampo at Teodoro Casiño noong Mayo 2008 kaugnay ng constitutionality ng undertaking nito. RNT/JGC
