Graft conviction ni Jun Lozada pinagtibay ng SC

MANILA, Philippines- Pinagtibay ng Korte Suprema nitong Biyernes ang graft ruling laban kay NBN-ZTE deal whistleblower Rodolfo Noel “Jun” Lozada Jr. sa paggawad niya ng leasehold rights sa pampublikong lupa sa kanyang kapatid sa ilalim ng government-owned corporation program.

Sa 17-page resolution, ibinasura ng Korte Suprema ang petisyon ni Lozada at ng kanyang kapatid na si Jose Orlando Lozada, at sinintensyahan sila ng minimum imprisonment na anim na taon at isang buwan at maximum imprisonment na 10 taon at isang araw.

Inakusahan ng Ombudsman si Lozada noong 2007 ng “partiality” at pagbibigay ng unwarranted benefits nang igawad niya ang mahigit  6.599 ektarya ng pampublikong lupa sa kanyang kapatid sa ilalim ng Lupang Hinirang Program ng Philippine Forest Corporation (Philforest).

Si Jun Lozada noong panahong iyon, ang presidente ng Philforest.

Hinatulang guilty sa graft ng Sandiganbayan ang magkapatid Sandiganbayan noong Agosto 2016.

“[R]odolfo’s issuance of a notice of award of leasehold rights in Orlando’s favor, despite non-compliance with the application and auction requirements, smacks of unwarranted and unjustified preference,” sabi ng SC.

“The fact that Orlando was granted a notice of award, even if he did not go through the required procedure, is sufficient to establish that there was a preference in his favor.”

“Lastly, the petitioners’ constitutional right to be informed of the nature and cause of the accusations against them was not violated,” patuloy pa nito.
