Kasong bribery vs De Lima, ex-bodyguard ibinasura ng Ombudsman

MANILA, Philippines- Ibinasura ng Office of the Ombudsman ang direct at indirect bribery charges laban kay dating Senator Leila de Lima at kanyang ex-bodyguard na si Ronnie Dayan, dahil sa lack of probable cause.

Sa nine-page resolution,sinabi ng Ombudsman na nakitaan nito ng inconsistencies ang testimonya ng self-confessed drug lord na si Kerwin Espinosa, Ram-Jhon Michael Espinosa at Marcelo Adorco kung paano ibinigay ang suhol at sa umano’y pakikipagkita kay De Lima sa Baguio City.

“After a painstaking review of the records, it appears that there is no probable cause to indict the respondents of the charges against them,” anito.

“Taken in isolation, the testimonies the complainant had presented may appear to espouse a well-generated belief that the respondents had indeed collected bribe money from Kerwin. However, when these statements are read together, glaring inconsistencies become apparent,” dagdag pa nito.

Nag-ugat ang kaso sa umano’y sabwatan sa pagitan nina De Lima at Dayan na mangikil ng pera mula kay Espinosa kapalit ng illegal drugs operations ng huli.

Magugunitang sa serye ng Senate hearings noong 2016, tumestigo si Espinosa na parte si de Lima ng illegal drug trade sa loob ng New Bilibid Prison habang siya ay nanunungkulan bilang Justice Secretary sa ilalim ng administrasyon ni late President Benigno “Noynoy” Aquino III.

Inakusahan pa ni Espinosa si De Lima na nakatanggap umano ito ng P8 milyon mula sa kanya para sa kanyang senatorial campaign na iniabot kay Dayan.

Subalit binawi ni Espinosa ang kanyang akusasyon laban kay De Lima noong Abril at sinabi sa kanyang counter-affidavit na siya ay “only coerced, pressured, intimidated, and seriously threatened by the police” upang sabihin ang mga naunang pahayag.

Sa four-page counter-affidavit, sinabi rin ni Adorco na napilitan siyang lagdaan ang affidavit sa takot para sa kanyang buhay at seguridad habang nasa Albuera Police Station noong 2016.

Base kay Adorco, isang pulis sa Albuera Police Station ang gumawa ng affidavit alinsunod sa utos ni Police Chief Inspector Jovie Espenido.

Sinabi niya na ginawa ang affidavit matapos silang mahuli sa isang buy-bust operation noong Hulyo 2016.

Duda rin ang Ombudsman kung bakit magbibigay si Espinosa ng P8 milyon nang hindi nakikipagkita kay De Lima.

“In particular, Kerwin and Adorco’s statements were inconsistent on how the alleged P8 million bribe money was delivered, the sequence of tranches of delivery, and, more importantly, whether De Lima was ever there to directly receive the money from Kerwin,” sabi nito.

“Failing to provide a semblance of clarity on these crucial details, it would be difficult to excite in a reasonable mind a well-founded belief that the respondents had received money from Kerwin in exchange of ‘protection for the latter’s illicit drug trade’” patuloy pa nito.

Iginiit din ng Ombudsman, “a reasonable mind cannot be faulted if it finds skepticism in the fact that Kerwin would give substantial amounts of money as bribe to Dayan without having met or at least had confirmed with De Lima that Dayan was in fact her emissary.” RNT/SA
