Limitadong fixed terms sa AFP, aprub na sa Senado

MANILA, Philippines- Inaprubahan nitong Lunes ng Senado sa ikatlo at huling pagbasa ang isang panukalang batas na naglilimita sa sakop ng three-year fixed term sa Armed Forces of the Philippines (AFP).

Layunin ng Senate Bill 1849, na amendahan ang Republic Act 11709, na pinaburan ng 17 boto, walang negatibo at abstensyon na boto.

Nakasaad sa panukala na itinakda sa lima ang fixed terms sa AFP ng tenured key officers:

  • AFP chief of staff: maximum tour of duty of three years;

  • Philippine Military Academy superintendent: maximum tour of duty of two years;

  • Commanding generals ng Philippine Army and Philippine Air Force, at flag officer ng Philippine Navy: tour of duty na dalawang taon.

“I hope that this measure will usher improved morale for our soldiers and officers of the Armed Forces of the Philippines,” ayon kay Sen. Jinggoy Estrada matapos aprubahan ang Committee Report No. 23.

Ayon kay Estrada: “This bill will also provide the AFP with the flexibility, stability and dynamism to adequately adapt and respond to the demands of the uncertain times.”

Tatanggalin naman sa listahan ng opisyal na mayroong fixed three terms ang vice chief of staff, deputy chief of staff, unified command commanders, at ang inspector general.

‘Under the measure, officers must have at least one year of active service before compulsory retirement for them to be eligible for appointment or promotion to the grade of brigadier general or commodore, or higher,’ ayon kay Estrada.

Itinakda din ng panukala sa 56 taong gulang ang retirement age maliban sa chief of staff, hepe ng tatlong major services, at PMA superintendent na kung saan ang retirement ay magkokompleto sa kanilang tour of duty o kung papalitan ng Pangulo.

Naunang ibinabala ni Senador Ronald “Bato” Dela Rosa na maaaring magkaroon ng sigalot sa loob ng AFP ang graduated age ng compulsory retirements ng opisyal ng militar na nakatakda sa committee report ng Senate national defense panel.

Intensiyon ng SB 1849 intends na amendahan ang Republic Act 11709 na nagtatakda ng three-year fixed terms sa key AFP officials, kabilang ang chief of staff.

Iniiwasan ng batas na magkaroon ng “revolving door policy” sa AFP na nilagdaan noon ni dating Pangulong Duterte ilang buwan bago ito umalis sa puwesto.

Ayon kay Defense Secretary Carlito Galvez. Jr, nagresulta ng sigalot sa unintended consequences ng RA11709 sa loob ng militar.

Tinutulan naman ni Senate Minority Leader Aquilino “Koko” Pimentel III ang pagsasabatas ng panukala sa Senado sa parehas na araw dahil nakatakda sa 1987 Constitution na kailangan tugunan ang public emergency o kalamidad ng urgent bills.

“I cannot believe that rumblings from the Armed Forces of the Philippines can be treated as a public calamity or emergency especially coming from a professional organization…Therefore, I move that we follow regular procedure and in accordance with our rules that the readings be on separate days,” ayon kay Pimentel.
