MANILA, Philippines- Sakaling maisabatas ang isang panukala sa Senado, nakatakdang bayaran ang sinumang motorist na hinuli sa maling kadahilanan na nagresulta ng pagsasayang ng oras, nawalang appointment at gumastos sa traffic violations.

Sa ilalim ng Senate Bill No. 1976 o ang Fair Traffic Apprehension Act, papanagutin ang sinumang nanlolokong traffic enforcer at maiwasang maabuso ang kapangyarihan nito sa hinaharap.

“Motorists experience tedious processes in contesting traffic apprehensions made against them, especially when the driver is under a no work, no pay policy. The bill seeks to provide compensation for drivers of motor vehicles who are wrongly apprehended for traffic violations,” ayon sa explanatory note sa panukalang inihain ni Senador Raffy Tulfo.

Layunin ng panukala na itaguyod ang transparency at accountability sa traffic enforcement system para mabenepisyuhann ang motorista at gobyerno.

Sakop ng panukala ang operatiba ng Land Transportation Office, Metropolitan Manila Development Authority, Land Transportation Franchising and Regulatory Board at local government units.

“Any driver of motor vehicle apprehended by any traffic enforcement personnel may contest the traffic apprehension before the traffic adjudication board of the traffic enforcement authority to which the traffic enforcer belongs within 60 days from the date of apprehension or discovery of the same,” ayon sa panukala.

Nakatakda din sa panukala ang probisyon na nagsasabing: “The driver is entitled to seek legal assistance from the Public Attorney’s Office and Integrated Bar of the Philippines; seek guidance and other form of assistance from advocate groups such as the Road Safety Advocates of the Philippines and other non-governmental organizations duly registered with the Securities and Exchange Commission; take photo or video to record or document the traffic apprehension and use the photo or video as evidence before the traffic adjudication board; bring not more than five persons during the hearing, including the witnesses and lawyer; record on video or live stream the proceedings; and receive compensation.”

Ayon sa panukala, nasa panig ng nanghuling traffic enforcement personnel ang burden of proof na kanyang patutunayan sa isang traffic adjudicatiom board na maayos na tiniketa ang drayber.

“Compensation is three times the amount as may be computed,” ayon sa panukala.

“If employed, the compensation is equivalent to the amount of daily wage multiplied by the number of times the driver took leaves of absence from work to contest the improper apprehension,” dagdag ng explanatory notes.

“If unemployed, self-employed or with business, the compensation is equivalent to the prevailing minimum wage in the locality where the driver was apprehended, multiplied by the number of times the driver appeared before the traffic adjudication board to contest the improper apprehension,” giit pa ng panukala.

Nakatakdang sampahan ng kasong administratibo laban sa sinumang traffic enforcement personnel na nagkamali sa paghuli o dahilan ng paghuli. Inaatasan din ang kinuukulang traffic enforcement authority na magsampa, motu proprio, ng kaukulang kasong administratibo laban sa nagmamalabis na tauhan sa ilalim ng civil service laws rules and regulations. MANILA, Philippines- Walang susunod na hakbang ang Philippine government matapos ibasura ng International Criminal Court, sa Appeals Chamber nito, ang petisyon na suspendihin ang imbestigasyon sa drug war sa bansa, ayon kay Pangulong Ferdinand “Bongbong” Marcos Jr. nitong Martes.

“We don’t have next move. That’s the extent of our involvement with the ICC. That ends our involvement with the ICC,” giit ni Marcos.

“The appeal has failed. In our view, there’s nothing more that we can do… At this point we are essentially disengaging from any contact, communication with the ICC.”

Binigyang-diin ni Marcos na wala nang ugnayan sa pagitan ng Pilipinas at ICC, at nanindigan sa posisyon ng pamahalaan na hindi ito makikipagtulungan sa international body.

“We ended up in the same position that we started with and that is we cannot cooperate with the ICC considering the very serious questions about their jurisdiction and about what we consider to be interference and practically attacks on the sovereignty of the Republic,” aniya.

“So that pretty much it, we have no longer any recourse when it comes to the ICC.”

MANILA, Philippines- Itinuturing na ng Department of Justice na isang pugante si Rep. Arnolfo “Arnie” Teves Jr. kahit wala pang iniisyu na warrant of arrest ang korte.

Ito ang tugon ni Justice Secretary Jesus Crispin Remulla sa pahayag ng abugado ni Teves na hindi masasabing pugante sa batas ang kaniyang kliyente dahil wala pa inilalabas na arrest order laban kay Teves.

Ayon kay Remulla, ang isang suspek sa krimen na nagtatago ay maituturing na pugante.

Malinaw aniya na ang patuloy na hindi pagharap ni Teves sa mga akusasyon laban sa kaniya ay pag iwas sa batas.

Ipinaliwanag ni Remulla na wala pang inilalabas na arrest order laban kay Teves dahil sa sinusunod na due process.

Iginagalang aniya ng DOJ ang batas sa due process kahit nagmimistulang mabagal ang usad ng kaso.

Sinabi tin ng kalihim na hindi basta maaaresto ang isang suspek dahil kailangan ibigay rito ang karapatan na idepensanang sarili sa korte. Teresa Tavares

Sinabi ni Guevara, na magkakaroon ng “serious and far-reaching consequences” ang nasabing ruling sa Pilipinas.

“It places us in the same class of rogue nations where the rule of law is not respected,” ang sinabi ni Guevarra sa isang panayam bilang reaksyon sa naging desisyon ng ICC Appeals Chamber.

“It is an indictment against our entire legal and judicial system, and it encroaches on our sovereignty as an independent and law-abiding nation,” dagdag na pahayag nito.

“It tends to humiliate us in the eyes of the international community, and this affront is irreversible and incorrectible even if we eventually win on the merits of our appeal,” aniya pa rin.

Dahil dito, sinabi ni Guevarra na ang Pilipinas ay hindi “legally at morally bound” para makipagtulungan sa ICC.

Sa pagtaggi sa apela ng Pilipinas, sinabi ng ICC Appeals Chamber na nabigo ang gobyerno na ipaliwanag ang “lack of jurisdiction” ng korte o nabigong magbigay ng paliwanag ukol sa implikasyon at saklaw ng imbestigasyon.

Tinukoy din nito na ang local investigation ay maaaring magpatuloy kahit pa nagpapatuloy ang ICC investigation.

Nauna rito, sinabi ni Justice Secretary Jesus Crispin Remulla na hindi maaaring pumasok ang ICC sa Pilipinas para imbestigahan ang war on drugs at magpatupad ng ibang rule of law.

Tinuligsa rin ng Kalihim ang desisyon ng ICC na muling buksan ang imbestigasyon sa United Nations Human Rights Council, sabay sabing “unjustified external interference rarely serves human rights.” Kris Jose

MANILA, Philippines- Nagpakawala ang Russia navy ng supersonic anti-ship missiles sa isang mock target sa Sea of Japan, ayon sa Russian defense ministry nitong Martes.

“In the waters of the Sea of Japan, missile ships of the Pacific Fleet fired Moskit cruise missiles at a mock enemy sea target,” pahayag nito sa Telegram account.

“The target, located at a distance of about 100 kilometers (62.14 miles), was successfully hit by a direct hit from two Moskit cruise missiles.”

Ang P-270 Moskit missile, na may NATO reporting name o SS-N-22 Sunburn, ay isang medium-range supersonic cruise missile mula sa Soviet, na kayang sumira ng barko na may layo hanggang 120 km (75 miles).

Ito ay kasunod ng paglipad ng dalawang Russian strategic bomber planes, kayang kumarga ng nuclear weapons, sa Sea of Japan sa loob ng mahigit pitong oras na ayon sa Moscow ay isang “planned flight”. RNT/SA
