‘Oplan Tokhang’ survivor pinawalang-sala sa direct assault

MANILA, Philippines- Pinawalang-sala ng Quezon City trial court ang survivor ng “Oplan Tokhang” anti-illegal drugs operations sa reklamong direct assault of police officers noong 2016.

Ang “Oplan Tokhang” ay isang anti-illegal drugs operation kung saan binibisita ng mga pulis ang mga tahanan ng mga hinihinalang sangkot sa iligal na droga.

Sa 18-page decision na may petsang March 17, pinawalang-sala ni Judge Gloria Monica Lopez-Lao ng metropolitan trial court (MeTC) si Efren M. Morillo sa kasong direct assault upon an agent to agent of a person in authority dahil sa “failure of the Prosecution to prove his guilt beyond reasonable doubt.”

Binaril ng mga pulis si Morillo na sinabing ipinagtanggol lamang ang sarili matapos paputukan sa kasagsagan ng “Oplan Tokhang” sa Barangay Payatas sa Quezon City noong Aug. 21, 2016.

Kinasuhan ng mga pulis si Morillo.

Sa kanyang desisyon, sinabi ni Judge Lao na “assiduously reviewing the record, the Court is convinced that the Prosecution failed to establish that all the aforementioned elements of Direct Assault are attendant in this case.”

“The Prosecution did not establish with moral certainty that accused Morillo assaulted, attacked and employed personal violence or intimidation on the police operatives,” giit ni Judge Lao.

Anang judgem bumase ang prosekusyon sa testimonya ni Police Officer Allan Formilleza na nagpaputok sa mga indibidwal, kasama si Morillo, sa nasabing operasypn.

“However, on cross-examination he (Formilleza) disclosed that he was unaware whether accused Morillo actually fired his gun,” anang judge.

Ikinatuwa naman ng Center for International Law (CenterLaw), legal counsel ni Morillo, ang desisyon ng korte.

Anito:  “Mr. Morillo and his legal team welcome the Quezon City trial court decision. It is a beacon of light for those whose hopes have been dimmed and distorted by the pro forma, lawless, and soulless ‘Nanlaban’ (fought back) narrative.”

“This decision is proof that truth will prevail and lives on. In light of this judicial finding, Mr. Morillo believes that his case before the Ombudsman should soon be resolved in his favor.”
