Panukalang magtatakda na ‘guilty’ agad ang isang drug suspect inalmahan ng solon

Manila, Philippines – Tinuring ni Quezon City Rep Bong Suntay na “patently unconstitutional” ang House Bill 7814 nagtatakda na guilty agad ang isang drug suspect “until proven innocent.”

Ayon kay Suntay, ang panukala na pumasa na sa ikatlo at huling pagbasa sa Kamara ay lumalabag sa karapatan ng isang inididwal.

“It has has far-reaching implications on the person’s individual rights. For me, it would be patently unconstitutional. It runs counter to Article 3 of the Constitution. It not only amends our Constitution, it also revises various penal laws, which provides the presumption of innocence on the part of a person accused,” paliwanag ni Suntay.

“I would rather see 10 guilty people be set free than have 1 innocent individual wrongly accused and put to jail. Once you take away liberty from a person, once you take time away from that person, this is something you can’t give back,” dagdag pa ng mambabatas.

Maliban sa “presumed guilty” ang nakumpiskahan ng illegal drugs, sa ilalim ng panukala ay maging ang may-ari ng ari-arian kung saan natagpuan ang nakumpiskang illegal drugs ay ipalalagay rin na guilty.

“While I’m also one with other legislators that we have to protect our children and citizens from the scourge of dangerous drugs, we should not sacrifice individual rights just because we want to strengthen our drug laws.”

Nanindigan ang mambabatas na ang guilt ng isang akusado ay dapat patunayan sa lakas ng ebidensya laban dito.

Nasa 180 mambabatas ang nagpasa ng House Bill 7814 na aamyenda sa Republic Act 9165 or Comprehensive Dangerous Drugs Act of 2002.

Gayunpaman para kay Suntay hindi kailangan pa na amyendahan. Gail Mendoza
