Publiko binalaan ng SEC vs Frutas Comida investment scheme

MANILA, Philippines – Binalaan ng Securities and Exchange Commission (SEC) ang publiko laban sa investment o pamumuhunan sa Frutas Comida Zamboanga na nag-aalok ng “guaranteed returns” na 20% kada buwan sa social media.

Sa isang advisory na may petsang Nobyembre 24, pinuna ng SEC ang investment solicitation activities ng Frutas Comida gayong hindi ito rehistrado sa SEC, at wala itong corresponding order ng registration ng securities and certificate of permit para mag-alok at magbenta ng securities.

Makikita sa post ng Frutas Comida sa kanilang Facebook page na hinihikayat nito ang mga investors na mamuhunan ng P5,000 hanggang P50,000, kapalit ng P6,000 hanggang P60,000 kada buwan.

Ang investments ay kinokolekta sa pamamagitan ng online banking channels at iba pang digital payment platforms

“Profits distributed to member-investors supposedly come from the sale of fruits and food tray packages,” ayon sa SEC.

“The scheme involves the sale and offering of securities to the public in the form of investment contracts, whereby a person invests his money in a common enterprise and is led to expect profits primarily from the efforts of others,” ayon naman sa SEC Enforcement and Investor Protection Department (EIPD).

Makikita sa rekord na hindi rehistrado ang Frutas Comida sa SEC bilang korporasyon o partnership, o awtorisadong mag-solicit ng investments mula sa publiko.

Wala itong lisensiya para makapag-solicit ng investments gaya ng nakasaad sa ilalim ng Seksyon 8 ng Republic Act No. 8799, o Securities Regulation Code (SRC).

“The public is hereby advised to exercise caution in dealing with any individual or group of persons soliciting investments for and on behalf allegedly of Frutas Comida Zamboanga. The public is further advised not to invest or to stop investing in the investment scheme being offered by any individuals claiming to represent said entity,” ang pahayag ng SEC Enforcement and Investor Protection Department (EIPD).
