Timbangan ng Bayan law tinintahan ni Digong

MANILA, Philippines – Nilagdaan na ni Pangulong Rodrigo Duterte ang isang batas na magtatatag ng Timbangan ng Bayan centers sa public at private markets para protektahan ang mga mamimili mula sa mapanlinlang at “unfair sales acts and practices.”

Pinirmahan ni Pangulong Duterte ang RA 11706, noong Abril 13, nag-aamiyenda sa Chapter II, Title III ng RA 7394 o mas kilala bilang Consumer Act of the Philippines.

Sa ilalim ng bagong batas, inaatasan ng Article 62-A ang lahat ng provincial, city, at municipal governments na magtayo ng accessible Timbangan ng Bayan Centers sa lahat ng public at private markets, kabilang na ang mga supermarkets, at kapag naisagawa na ay sa mga flea markets o tiangges at grocery stores, sa loob ng kani-kanilang lokalidad.

“Timbangan ng Bayan Centers will provide consumers with an effective means of checking the accuracy of the weight and the quantity of the goods that they are buying,” ayon sa batas.

“These centers must have the necessary instruments for determining weights and measures, which shall be available, free of charge, to all persons who need to confirm the accuracy of the quantity or measurements of products purchased or about to be purchased,” ang nakasaad pa rin sa batas.

Nakasaad pa rin sa batas na ang market supervisor ang siyang magiging “in charge” sa safekeeping at routine maintenance ng Timbangan ng Bayan instruments at magiging responsable sa pagpapanatili ng rekord ng bawat produkto na matutuklasang “deficient” o kulang sa bilang o timbang at substandard sa dimension, at maging sa establishment kung saan parehong binili ang produkto kabilang na ang “name/s of the proprietor/s or manager/s.”

Ang sertipikasyon na ipalalabas ng market supervisor o ng kanyang awtorisadong kinatawan ay sumasalamin sa nilalaman ng rekord at magsisilbing “prima facie evidence” sa paglabag sa Article 64 of this act.

“RA 11706 includes among the prohibited acts fraudulently altering, tampering, vandalizing or destroying any scale, balance, Timbangan ng Bayan instrument, weight or measure after it is officially sealed,” ayon sa batas.

“As for penalties, anyone who is guilty of prohibited acts may be fined not less than PHP50,000 but not more than PHP300,000 or by imprisonment of not less than one year but not more than five years or both upon the discretion of the court,” ang nakasaad sa batas idagdag pa ang “The owner, possessor, or user of instruments of weights and measures, upon conviction, will be subject to a fine of not less than PHP50,000 but not more than PHP300,000 or by imprisonment of not less than one year but not more than five years or both, upon the discretion of the court.”

Ang dalawang magkasunod na paglabag ay awtomatikong magreresulta ng kanselasyon ng business permit ng tiwaling indibiduwal o business establishment.

Samantala, ang Department of the Interior and Local Government at Department of Trade and Industry, ay kailangan na makipagtulungan sa Union of Local Authorities of the Philippines, League of Provinces of the Philippines, League of Cities of the Philippines, League of Municipalities of the Philippines, at iba pang kaugnay na government agencies at stakeholders, ipahayag at ipalaganap ang rules and regulations para sa epektibong implementasyon ng probisyon ng batas.

“The amount necessary to carry out the provisions of the new Article 62-A of the Consumer Act of the Philippines will be charged against the national tax allotment and other funds of the local government unit concerned,” ayon sa batas. Kris Jose
