MANILA, Philippines – Kinastigo ni Solicitor General Menardo Guevarra nitong Miyerkules, Marso 29, ang International Criminal Court (ICC) sa hindi nito pagsunod sa sariling batas sa pagtutulak ng imbestigasyon sa anti-drug war campaign ng pamahalaan sa ilalim ni dating Pangulong Rodrigo Duterte.

Ani Guevarra, hindi sumusunod sa sariling prinsipyo ang ICC, ito ay ang principle of complimentarity na nangangahulugang kikilos lamang ito bilang suporta sa sistema ng member state nito, kung walang “genuine investigation and prosecution” na isinasagawa.

“Is the ICC following its own principle of complimentarity? No. In so far as we are concerned, the complimentarity principle that underlies the workings of the ICC is not being followed by the ICC itself,” sinabi ni Guevarra sa panayam ng ABSCBN.

Iginiit ni Guevarra na iniimbestigahan na ng Pilipinas ang mga pagpatay sa naturang anti-drug campaign, at hindi na kailangan pang makialam ang ICC.

“Your [ICC] role is simply complimentary. Only when there is no genuine investigation and prosecution being conducted by the domestic institutions may you come in but you are coming in despite the fact that we are doing what needs to be done in a genuine manner,” dagdag pa niya.

“So it’s you, the ICC, who is not following your own principles,” pagpapatuloy ng Solicitor General.

Ang pahayag na ito ni Guevarra ay matapos na ibasura ng ICC Appeals Chamber ang hiling ng pamahalaan na huwag nang ituloy ang imbestigasyon nito sa drug war killings.

Ani Guevarra, na nagsilbing Justice Secretary sa kasagsagan ng drug war campaign ng Duterte administration, ang war on drugs ay hindi crime against humanity dahil ito ay isang lehitimong law enforcement operation.

“We do not consider the war on drugs as a crime against humanity because it is a legitimate law enforcement operation.

“It’s called ‘war on drugs’, it’s not a war on drug users or a war on drug pushers. It’s a war against the crime itself. The operation called war on drugs does not fit on the concept of a crime against humanity,” dagdag niya. RNT/JGC

MANILA, Philippines – Sinabi ng abogado ni suspended Negros Oriental Representative Arnolfo “Arnie” Teves Jr. na may ilang indikasyon siyang nakikita na posibleng ang preliminary investigation sa pagpatay kay Negros Oriental Governor Roel Degamo ay magiging isang kangaroo court.

Sa episode ng The Mangahas Interviews na inere nitong Martes, Marso 28, sinabi ni Atty. Ferdinand Topacio, abogado ni Teves, na nababahala siya sa sinabi ni Justice spokesperson Atty. Mico Clavano na ang
Department of Justice (DOJ), National Bureau of Investigation, at pulisya ay nagsasagawa ng case build-up sa naturang kaso.

“Eh, ‘yung prosecutors po ang mag de-determine in the first place kung may probable cause or wala. Eh, bakit kasama sa build-up ang prosecutors… Eh, papaano ngayon sila mismo ang nag-case build-up. Papaano nila kokontrahin ang sarili nila,” pahayag ni Topacio.

“So all indications point to the fact that this is going to be some sort of kangaroo court,” dagdag pa niya.

Inilalarawan ng Cornell Law School ang kangaroo court bilang “an authorized court or legal proceeding in which fair proceedings are impossible due, for example, to a partial judge or excessive press coverage.”

Noong Pebrero, sinabi ni Justice Secretary Jesus Crispin Remulla na bumubuo na ang pamahalaan ng batas na pumapayag sa prosekusyon na makipagtulungan sa mga pulis, katulad ng isang district attorney.

Sa ngayon ay wala pang tugon ang DOJ sa sinabi ni Topacio.

“I hope I’m proven wrong pero gano’n na ba kababa ang nangyari sa sistema ng hustisya ng ating bayan na foregone conclusion na meron talagang kasong ifa-file sa isang taong iniimbestigahan pa lamang?” giit ni Topacio.

Matatandaan na pinagbabaril-patay noong Marso 4 si Degamo at walo iba pa sa harap mismo ng tahanan nito sa Pamplona, Negros Oriental.

Naiugnay dito si Teves makaraang sabihin ng ilang nahuling suspek sa pagpatay na isang “Cong. Teves” umano ang nag-utos sa kanila na patayin ang gobernador.

Sa kabila ng paratang, tumangging umuwi ng bansa ang mambabatas dahil natatakot aniya siya sa mga banta sa kanyang buhay maging ang kanyang pamilya.

Kasunod nito ay nanawagan siya sa mga awtoridad na maging patas at tingnan ang lahat ng anggulo sa pagpatay kay Degamo. RNT/JGC

MANILA, Philippines – Umapela si Senate constitutional amendments and revision of codes chairman Robin Padilla sa mga lider ng Senado na agad magsagawa ng pagpupulong kasama ang kanilang counterparts sa Kamara para pag-usapan ang nais na pamamaraan upang amyendahan ang economic provisions ng 1987 Constitution.

Nitong Lunes, Marso 27, nagpadala ng magkahiwalay na liham si Padilla kina Senate President Juan Miguel Zubiri, Senate President Pro Tempore Loren Legarda, Majority Leader Joel Villanueva, at Minority Leader Aquilino Pimentel III na humihiling na tugunan na ang suhestyon ni Speaker Ferdinand Martin Romualdez na pag-usapan na ang Charter change sa pamamagitan ng constituent assembly (con-ass).

“With the foregoing, I sincerely hope that the leadership of our beloved institutions, led by your representation, will forge ahead and make a move to respond to the suggestion of the House of Representatives to sit together and deliberate on the matter, ultimately, for the benefit of our countrymen,” saad sa liham ni Padilla.

“I encourage and appeal for our collaborative effort towards a common goal of achieving a more vibrant and dynamic economy for our people,” dagdag pa niya.

Ang Kamara ay nagsusulong na amyendahan ang 1987 Constitution sa pamamagitan ng isang constitutional convention (con-con) habang si Padilla naman ay nagsusulong ng con-ass.

Wala pang tugon sina Zubiri, Villanueva at Pimentel kaugnay ng hiling ni Padilla.

Kasabay naman ng Kapihan sa Manila Bay, sinabi ni Legarda na hindi pa niya nababasa ang liham ni Padilla, sabay-sabing hindi prayoridad ang charter change sa ngayon.

“There’s a time for everything and I personally feel that the issue of changing the constitution may not be here and now. It’s not for now,” ani Legarda.

Sa ngayon, sinabi ni Legarda na dapat tutukan ng pamahalaan ay ang problema sa langis, unemployment, at iba pang pandemic-related na problema.

Iginiit din niya na mayroong tatlong kapapasa lamang na batas na posibleng tumugon sa sinasabi niyang “restrictive economic provisions” ng 1987 Constitution. RNT/JGC

MANILA, Philippines – Nanindigan si Vice President at Education Secretary Sara Duterte nitong Miyerkules, Marso 29, na imposible talaga ang pagkuha ng 30,000 bagong guro taon-taon at pagpapatayo ng 50,000 bagong silid-aralan.

Kasabay nito ay sinupalpal din niya ang ACT Teachers party-list na nagbubulag-bulagan ito sa nangyayaring bakbakan malapit sa mga paaralan sa Masbate sangkot ang rebeldeng grupo.

Ani Duterte, hindi bulag ang Department of Education (DepEd) sa mga problemang kinakaharap ng education system, maging ang pagkuha ng karagdagang guro at administrative staff, kasama na ang pagpapatayo ng mga bagong silid-paaralan.

“While these are pursued along with the implementation of other essential reforms, DepEd should not only be limited to dispensing old-fashioned solutions but must also innovate. May I reiterate that ACT Teachers’ suggestions were both unrealistic and impossible — presented to shame the government and deceive the public into believing that the hiring of teachers and increasing the education budget were their ideas,” pahayag ni Duterte.

“The Department will not surrender or fall for the mad ruse of a party-list group that has mastered the art of duplicity,” dagdag pa niya.

Iginiit ng Education chief na sa halip ay dapat kondenahin ng ACT Teachers party-list ang New People’s Army sa paghahasik nito ng terorismo sa Masbate na nagresulta sa suspensyon ng klase sa anim na bayan sa probinsya.

“We should only take ACT Teachers seriously if it publicly condemns NPA atrocities in Masbate and all other NPA terroristic activities that hampered the learning of children across the country,” sinabi pa ni Duterte.

“The real victims here are the learners, and the Department of Education is pouring in all our efforts to solve the problem,” dagdag niya.

Bilang tugon, kinontra naman ni House Deputy Minority Leader France Castro ng ACT Teachers party-list ang pahayag ni Duterte at sinabing katanggap-tanggap ang hiling nilang 30,000 bagong guro at 50,000 bagong classroom, katulad ng ginawa ng dalawang nagdaang presidente na sina dating Pangulong Benigno Aquino III at dating Pangulong Rodrigo Duterte.

“Our call for hiring 30,000 new teachers and constructing 50,000 new classrooms yearly, until 2028, to eradicate teacher and classroom shortages and improve education quality are perfectly legitimate and logical demands. In fact, the past two administrations were able to get near these targets as the Aquino administration hired an average of 29,166 teachers per year and even the administration of the current vice-president and concurrent Department of Education (DepEd) secretary’s father was able to hire 25,000 teachers per year,” ani Castro.

“Malinaw sa kasaysayan na kaya itong magawa, ibukas lang sana ang isipan at ‘wag puro red tagging ang inaatupag,”pagpapatuloy nito.

Dahil dito, nagtataka si Castro kung bakit “unrealistic” at imposible ang bagay na ito para kay Duterte.

“Blended learning won’t work in the long run because it is just DepEd’s way of passing the teaching responsibility to the parents. Learning gap is worsening because blended learning is not fit for the country,” ipinunto pa niya.

Maliban dito, sinabi rin ni Castro na ang insidente sa Masbate ay kinondena niya rin at nanawagan pa nga siya ng imbestigasyon para rito.

“As for the incidents in Masbate , they are indeed condemnable and an independent probe should be conducted by forensic experts and the Commission on Human Rights to see the real perpetrators of the gun firing near the schools,” sinabi ni Castro.

“These incidents also highlight the need for the resumption of the peace negotiations between the Government of the Republic of the Philippines (GRP) and the National Democratic Front of the Philippines (NDFP) to address the root causes of the armed conflict,” dagdag pa niya. RNT/JGC

MANILA, Philippines- Nagpasalamat ang Makabayan Bloc sa International Criminal Court (ICC) sa desisyon nitong ituloy ang drug war inquiry sa nangyaring patayan noong termino ni dating Pangulong Rodrigo Duterte sa kabila ng apela ng pamahalaan na huwag na itong ituloy.

Ayon kay Alliance of Concerned Teachers Party-list Rep. France Castro, isa sa miyembro ng Makabayan Bloc, tama lamang na gawin ang imbestigasyon, sa katunayan “long overdue” na ito at malaki na din ang sakripisyo ng mga kaanak ng biktima.

Matatandaan na umapela ang Marcos administration sa ICC Appeals Chamber na itigil na ang drug war probe sa basehang walang hurisdiksyon ang ICC sa bansa, gayunpaman, ang naging tugon ng ICC ay walang legal basis para itigil ang imbestigasyon.

“The denial of the ICC appeals chamber on the Marcos-Duterte administration’s bid to suspend the probe on former Pres. Rodrigo Duterte’s bogus drug war is a welcome development in the quest for justice for the victims of extra-judicial killings during the drug war and their families,” ani Castro.

“The cases have been long delayed, and only some have been brought to courts but many have been killed. Asking for the suspension of the probe is obviously a delaying tactic of the Marcos-Duterte administration with the goal of protecting people involved in the drug war,” dagdag pa ng lady solon.

Noong Hunyo 2021 ay hiniling ni ICC prosecutor Fatou Bensouda sa ICC Pre-Trial Chamber na payagang imbestigahan ang drug war ni Duterte na kalaunan ay pinahintulutan naman ng Pre-Trial Chamber.

Sinabi ni dating Pangulong Duterte na 2018 pa nang umalis ang Pilipinas bilang ICC member kaya wala na itong hurisdiksyon sa bansa subalit iginiit ni Bensouda na ang mga krimen na kanilang iimbestigahan ay naganap nang ang Pilipinas ay kasapi pa ng Rome Statute kaya naman malinaw na mayroon itong hurisdiksyon. Gail Mendoza
