Vape Bill ‘di health measure – FDA

MANILA, Philippines- Inihayag din ng Food and Drug Administration (FDA) ang apela ng Department of Health (DOH) para sa isang presidential veto sa consolidated House Bill No. 9007 at Senate Bill No. 2239 o Vape Bill, at nilinaw na hindi ito isang health bill.

Sinabi ni FDA officer-in-charge Director General Oscar Gutierrez Jr. nitong Huwebes na ang pagpasa sa panukala ay sasalungat sa “significant progress” ng Duterte administration kabilang ang pag-isyu ng landmark legislation at executive directives kagaya ng smoke-free at vape-free policies at ng sin tax reforms.

“The FDA calls for the continuity of these initiatives and the consequent strengthening of the Tobacco Control and Prevention Strategy of the Philippine Government, ultimately for the protection of public health and safety,” pahayag nito.

Ang DOH, sa pamamagitan ng FDA, “bears the constitutional mandate to protect every Filipino’s right to health by establishing effective regulatory systems.”

Binaggit nito ang hatol ng Supreme Court decision sa kaso laban sa Philippine Tobacco Institute Inc. na nagpapatibay sa regulatory jurisdiction ng FDA sa lahat ng health products kabilang ang tobacco at iba pang produkto.

Iginiit ni Gutierrez na ang FDA “has the rightful authority, possessing the expertise, competencies, and manpower to develop standards to regulate and monitor novel tobacco products.”

Hindi rin sang-ayon ang FDA sa intent ng Vape Bill na ilipat ang regulatory jurisdiction ong mga produkto sa ahensya ng Department of Trade and Industry (DTI).

“In expressing this, the FDA does not intend to undermine the DTI, but rather the FDA wishes to respect the delineation made between the jurisdiction of the DOH and the DTI on consumer products in the Republic Act 7394, otherwise known as the Consumer Act of the Philippines, where health products, including hazardous substances, are under the jurisdiction of the DOH,” sabi ni Gutierrez.

“The FDA has, in fact, regulations in place to legitimize manufacturers, traders, distributors, and retailers of such products,” ayon sa pahayag.

Sa kasalukuyan, ang  FDA ang nagpoproseso sa lisensya na mag-operate ang mga establisimiyento na may listing para sa publiko na makikita sa FDA verification portal. RNT/SA
